You are probably right, but this usage seems very ingrained in org-mode’s code. So users have to rely on it working properly, until/unless it can be changed to some more correct idiom. AFAIK there's no other way offered by Emacs. `invisible' actually removes the text from the output rather than leaving blank space, so it doesn't provide the same feature.
