I would expect e.g.

     <li class="off"><p><code>[&#xa0;]</code> bar</p>

If an item contains block-level element then text paragraphs should be 
wrapped with <p>...</p>, however there is no reason to put checkboxes 
outside of first paragraphs.

HTML lists are including paragraphs (<li><p>…</p></li>)
