I cannot reproduce it.
My export is  fine, I have the horizontal rule outside the </ol> environment.

GNU Emacs 23.1.91.1 (i386-mingw-nt5.1.2600) of 2010-01-03 on PRETEST
Org-mode version 6.34trans.
Windows XP SP3

Vincent, what are your org-version and emacs-version and Operating System?
