     - commenting the top level item does not preserve the list,
       but strangely, commenting this subitem is ok.

my preference is the subitem behavior.

but in any case is this inconsistent?

please note that i am using an old version of org [because capture
inserts blank lines in recent versions and i haven't figured out] so
this might have been fixed.
