Using the new HTML exporter with this file: #+OPTIONS: H:2 num:t toc:nil * one ** two *** three *** three (bis) I get an enumerated list for "three" and "three (bis)" -- maybe I lost track of what the problem was, but this looks like what you are looking for, doesn't it?
